The submission of information to, and use of, the real estate information services available through the TRACK RENTAL web site (located at www.trackrental.com) is subject to the following terms and conditions (the "Terms and Conditions" or the "Agreement"). BY SUBMITTING INFORMATION to, or accessing information from, YOU, the end user customer ("Customer") AGREE TO THE FOLLOWING TERMS AND CONDITIONS. These Terms and Conditions are a legal agreement between you and TRACK RENTAL, LLC. ("TRACK RENTAL ").
Customer agrees to submit any property descriptions, photographs, financial, contact or other information to TRACK RENTAL. The TRACK RENTAL may, in its sole discretion but without any obligation to search for such, remove properties that are alleged to have been submitted in violation of this conditions. TRACK RENTAL will, in its sole discretion, terminate the cooperation, and refuse service to, any Customer who repeatedly or knowingly violates this agreement. Customer agrees to maintain accurate contact information (specifically, a valid phone number and email address) in order to submit and maintain active property listings on the TRACK RENTAL web. Additionally, the Customer agrees to allow the property listing, or any part of it, to be searched, displayed, accessed, downloaded, copied, and otherwise referred to by users of the Customer's website or the TRACK RENTAL website. TRACK RENTAL shall have the sole authority to choose the manner in which any property will be searched, displayed, accessed, downloaded, copied, and otherwise used on the TRACK RENTAL website and TRACK RENTAL shall have the right to modify the property listing in the exercise of its rights under this Agreement. The Customer (a) represents and warrants that all properties and associated information provided by the Customer will be accurate; (b) agrees to administer the properties provided by the Customer and maintain their accuracy at all times. TRACK RENTAL reserves, in a manner consistent with reasonable commercial business practices, the right to remove all or any part of the Properties posted on the Customer's website or on the TRACK RENTAL website. The Company accepts no responsibility for checking the accuracy of reports or data files submitted by the Customer.
TRACK RENTAL shall not be liable for any indirect, special, incidental or consequential damage caused by the third parties if the TRACK RENTAL could not avoid such damage to be arisen.
All notices to TRACK RENTAL must be in writing and must be sent registered mail, certified mail, or overnight mail with a return receipt.
The terms and conditions of this Agreement constitute the entire agreement between the parties and supersede all previous agreements and understanding, whether oral or written, between the parties hereto with respect to the subject matter of this agreement.
TRACK RENTAL retains all rights (including Intellectual Property Rights), title and interest in the TRACK RENTAL Web site, Prospects technology and brochures, Email Alert database, Site Builder technology, and all underlying technology and data including any enhancements and improvements thereto.
Customer agrees that TRACK RENTAL shall have the right to use listings and other information submitted to it for any purpose, including without limitation for publication of all or part of such listing on the Internet for unrestricted use by TRACK RENTAL customers and partners.
Track Rental will take all reasonable precautions to ensure that any tenant is a fit and decent person to hold such a tenancy, however thereafter Track Rental not be liable for any damage to, theft from, or other distress caused to the property or its contents whatsoever.
In all cases where the property is either a former local authority or housing association dwelling, the landlord MUST provide to Track Rental documentary evidence that he/she is the lawful owner and has the right to offer the property for rent. Such proof can be demonstrated by providing Track Rental with a Tax Bill to show he/she is the lawful owner and has the right to offer the property for rent.
Track Rental will issue payment to the Landlord immediately after initial deposit has cleared and the Landlords portion of the Lease Agreement has been signed. In doing so, Track Rental will also supply both parties with the executed Lease Agreement. This is if the Landlord is able to provide Track Rental with documentary evidence that he/she is the lawful owner of the property for rent.
When agreeing to these Terms, the Landlord also agrees to pay Track Rental 15% or a minimum of four hundred dollars ($500) on each individual rental as commission for providing service, legal documentation, and an arrangement to both the third party and the Landlord. The commission totals the rental amount only while the security deposit is exempt. This payment will be deducted directly from the initial payment administered by the Lessee. Any cleaning the Landlord may wish to include must be included in total rental cost. No additional cleaning fee may be brought forth to the Lessee unless any extensive or out of the ordinary event may have occurred that requires additional cleaning services. Required cleaning services may be deducted from the Security Deposit at the Landlord's discretion. Track Rental assumes no reasonability for additional charges that the rental may entail.
All reservations are final and initial deposits are nonrefundable. If the Lessee needs to terminate the rental for any reason after the initial deposit has been distributed and Lease Agreement have been signed by both parties, the Lessee understands they are forfeiting their initial deposit. However, the Lessee if not obligated to pay remaining balance to the Landlord if they cancel two weeks prior to their scheduled arrival.
